Recruiting Terms and Conditions

These Recruiting Terms and Conditions (“Terms”) govern your use of Global Data and BI Inc.’s (“GDBI,” “we,” “us,” “our”) online job application process, including any job posting page, application form, or related communication. By submitting an application, you agree to these Terms. If you do not agree, please do not submit an application.

These Terms work alongside, and do not replace, our Global Recruiting Privacy Policy, which explains how we collect and use your personal information. Where these Terms and the Privacy Policy address the same topic differently, the Privacy Policy governs how we handle your data, and these Terms govern the application process itself.

1. Eligibility to apply

You may apply to a posted role if you meet the qualifications described in that role’s job posting. There is no minimum age to apply beyond the general requirement, described in our Privacy Policy, that our recruiting activities are not directed at individuals under 18.

2. One application process, multiple roles

Our application form is job-specific: information you submit for one posting is not automatically considered for another unless you separately apply. We may, consistent with our Privacy Policy, keep your information on file to consider you for other suitable roles.

3. Accuracy of the information you provide

You confirm that all information you submit, including your name, contact details, resume or CV text, work history, education, certifications and certification links, professional networking and portfolio URLs, work-authorization and citizenship or residency information, and rate expectations, is true, current, and not misleading. You agree to promptly update us if any of this information materially changes while your application is under consideration (for example, a change in your work-authorization status).

Submitting false, altered, or materially misleading information is a Prohibited Application under Section 10 and may result in your application being rejected or, if discovered after an offer or hire, in withdrawal of the offer or termination of engagement, without limiting any other remedy available to us.

4. How applications are reviewed

When you submit an application, it is recorded in our applicant-tracking records and goes through an initial email-verification step. Some applications are reviewed with the assistance of automated tools that generate preliminary indicators (such as a fit score or written summary) from the information you submitted; a human reviewer always makes the actual decision on your application, as described in our Privacy Policy. We may contact you by email, including automated verification, confirmation, and status emails, at the address you provide, and you may opt out of non-essential recruiting communications at any time using the link provided in those emails, without affecting our processing of an application already submitted.

5. No guarantee of employment; discretion in hiring

Submitting an application, completing an interview, or receiving positive feedback at any stage does not guarantee an offer of employment or engagement. GDBI decides, in its sole discretion, whether to interview any applicant, extend an offer, or proceed with a hire, based on business needs that may change at any time, including after an application is submitted. Nothing in these Terms, in a job posting, or in any communication during the application process creates an employment, contractor, or other engagement relationship between you and GDBI; that relationship, if any, is created only by a separately signed offer letter or agreement, which will set out its own governing terms, including which jurisdiction’s employment or contractor law applies to your specific engagement.

6. Right to modify or withdraw a job posting

We may edit, pause, or remove any job posting at any time, for any reason, including after you have applied and before any hiring decision is made. If we withdraw a posting you applied to, we will not automatically notify every applicant, though your application data continues to be handled under our Privacy Policy and you remain free to contact us about its status.

7. Background checks

For roles where a background check is part of our process, you will be asked to acknowledge this as part of the application. Acknowledging this means you understand that, if you advance in the process, we or a background-check service provider acting on our behalf may verify information you’ve provided, such as employment history, education, and professional certifications, and, where applicable and permitted by law, criminal record or reference checks, and that any offer may be conditioned on the results. We will seek any additional consent required by law before initiating a specific check, and you may withdraw consent by withdrawing your application, though this may end your candidacy for the role.

8. Work authorization representations

Where our form asks about your citizenship, country or region of residence, and ability to work in a given jurisdiction, your responses are representations we rely on in evaluating your application. You confirm you have accurately described your current work authorization status and will inform us promptly if it changes. Providing inaccurate work-authorization information is treated the same as any other material misrepresentation under Section 3.

9. Certifications and credentials

If a role requires or allows you to submit professional certification links, you confirm that any certification, license, or credential you reference is one you currently and legitimately hold, and that any link you provide resolves to a verification page or record that actually corresponds to you. We may independently verify any certification you reference.

10. Prohibited applications

You agree not to:

  • Submit an application containing false, altered, or materially misleading information;
  • Submit an application on behalf of someone else without their knowledge and authorization;
  • Submit multiple applications for the same role in a way intended to circumvent our review or rate-limiting protections (our application form is protected against automated and bulk submissions);
  • Use automated tools, scripts, or bots to submit applications; or
  • Submit any content in your application that infringes a third party’s intellectual property or confidentiality obligations to a current or former employer.

We may reject, disqualify, or remove any application that violates this section, and may take further action described in Section 3 if this is discovered after an offer or hire.

11. Intellectual property in application materials and work samples

You retain ownership of any resume, cover letter, portfolio, work sample, or other material you submit as part of your application (“Application Materials”). By submitting Application Materials, you grant GDBI a non-exclusive, royalty-free license to use, copy, and share your Application Materials internally for the purpose of evaluating your candidacy, consistent with our Privacy Policy. You confirm you have the right to submit any work sample you provide, for example, that it is your own original work, or that you have permission from any employer or client who owns rights in it, and that sharing it with us does not breach any confidentiality obligation you owe to a third party. If a role’s assessment process asks you to complete a paid or unpaid work sample specifically for GDBI (as distinct from a pre-existing portfolio piece), the terms of that specific assessment, including any compensation and who owns the resulting work, will be described separately when the assessment is assigned, and those specific terms control over this section for that assessment.

12. Equal employment opportunity

GDBI is committed to equal opportunity in recruiting and hiring. We evaluate applicants based on their qualifications for the role, and we do not discriminate on the basis of race, color, religion, sex, sexual orientation, gender identity or expression, national origin, age, disability, family or marital status, genetic information, veteran status, or any other characteristic protected by applicable law in the jurisdiction where the role is based.

13. Third-party job boards and links

If you find or apply to a GDBI role through a third-party job board, career site aggregator, or similar service, that service’s own terms also apply to your use of it; we are not responsible for that service’s practices, and these Terms apply to your interaction with GDBI’s own application form regardless of where you found the posting.

14. Disclaimer of warranties

OUR APPLICATION PROCESS, JOB POSTINGS, AND RELATED COMMUNICATIONS ARE PROVIDED “AS IS.” GDBI DOES NOT WARRANT THAT JOB POSTINGS ARE ERROR-FREE, THAT THE APPLICATION SYSTEM WILL BE AVAILABLE WITHOUT INTERRUPTION, OR THAT ANY PARTICULAR TIMELINE FOR REVIEW WILL BE MET.

Job posting content, such as compensation ranges or role descriptions, is accurate to the best of our knowledge as of the posting date but may change.

15. Governing law and disputes

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles, except that nothing in these Terms limits any right you have under mandatory employment-standards or human-rights legislation that cannot be waived by agreement. Before initiating a formal legal claim, we ask that you first contact us at recruiting@globaldataandbi.com so we can try to resolve the issue informally.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GDBI IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR APPLICATION PROCESS, INCLUDING ANY DELAY, ERROR, OR INTERRUPTION IN THE APPLICATION SYSTEM.

This limitation does not apply where such liability cannot be limited by law, including liability for GDBI’s own fraud, gross negligence, or violation of mandatory employment or human-rights law.

17. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. If you have an application actively under review when these Terms change, the version in effect at the time you submitted your application continues to govern that application unless we notify you otherwise.
